Equipment Rental Terms & Conditions

INTRO: These Rental Terms and Conditions govern all equipment and attachment rentals from Valley Stone Ranch Land Clearing & Development. By booking a rental, submitting a deposit, or taking possession of any equipment you agree to be bound by these terms in full. Please read carefully before booking.
1. RENTAL COMPANY INFORMATION

2. ELIGIBLE RENTERS
To rent equipment from Valley Stone Ranch Land Clearing & Development you must:

Be at least 18 years of age

Provide a valid government-issued photo ID at time of booking

Provide proof of property ownership or written authorization from the property owner where equipment will be used
-
Have the physical ability and experience to safely operate the rented equipment
-
Pay the required deposit at time of booking
Valley Stone Ranch Land Clearing & Development reserves the right to refuse rental to any person at our sole discretion.
3. AVAILABLE EQUIPMENT AND RATES
We offer the following equipment and attachments for daily rental:
Heavy Equipment:

2025 JCB 270T Compact Track Loader — From $500.00 per day (24 hours)

2019 CAT 316 Excavator — From $500.00 per day (24 hours)
Attachments:

THE MEGA MOWER X High Flow Brush Cutter — From $300.00 per day (24 hours)

Eagle Talon Grapple — From $150.00 per day (24 hours)

Track Loader Bucket — From $60.00 per day (24 hours)
All rates are per 24-hour rental period. Multi-day rental rates may be available — contact us for pricing. Rates are subject to change without notice. The rate confirmed at time of booking will be honored for that rental period.
4. RENTAL PERIOD

All rentals are based on a 24-hour rental period beginning at the time of pickup or delivery

Equipment must be returned by the agreed return time
-
Late returns will be charged at the full daily rate for each additional 24-hour period or portion thereof
-
Extensions must be approved in advance by calling or texting (956) 274-1624

Renter is responsible for the equipment from the time of pickup or delivery until the time of return or pickup by Valley Stone Ranch Land Clearing & Development

5. DEPOSIT AND PAYMENT

A deposit is required at time of booking to secure the rental — deposit amount will be confirmed at time of booking

The deposit will be applied toward the total rental cost

The remaining balance is due before equipment is released for rental
-
Accepted payment methods: cash, check, Zelle, and other methods as agreed
-
Returned checks are subject to a $35 returned check fee
-
The deposit may be withheld in full or in part to cover damage, excessive cleaning, late returns, fuel, or any other charges incurred during the rental period

6. CANCELLATIONS AND REFUNDS

Cancellations made more than 48 hours before the rental start time — full refund of deposit minus a $75 processing fee

Cancellations made within 48 hours of the rental start time — full deposit forfeited
-
No shows — full deposit forfeited and renter may be charged for any costs incurred
-
Valley Stone Ranch Land Clearing & Development reserves the right to cancel a rental at any time due to equipment mechanical issues, safety concerns, or other circumstances — in this case a full refund of the deposit will be issued

7. EQUIPMENT CONDITION AND INSPECTION

All equipment is inspected and documented before each rental
-
Renter must inspect the equipment at time of pickup or delivery and report any pre-existing damage before operating
-
Failure to report pre-existing damage before operation may result in renter being held responsible for that damage
-
By accepting the equipment renter acknowledges it is in good working condition and fit for its intended purpose

Valley Stone Ranch Land Clearing & Development makes no warranty express or implied regarding the fitness of the equipment for any particular purpose beyond its designed and intended use
8. RENTER RESPONSIBILITIES
By renting equipment from Valley Stone Ranch Land Clearing & Development the renter agrees to:

Operate equipment only for its intended purpose and within its rated capacity

Never allow any person other than the approved renter to operate the equipment without prior written consent
-
Never operate equipment under the influence of alcohol, drugs, or any substance that impairs judgment or reaction time
-
Comply with all applicable federal, state, and local laws and regulations while operating the equipment
-
Call 811 at least 48 hours before any digging, trenching, or augering and ensure all underground utilities are marked
-
Keep all unauthorized persons, children, and pets away from the equipment during operation
-
Secure and store equipment safely when not in use
-
Not transport equipment to any location other than the approved job site without prior written consent
-
Not modify, alter, or attempt to repair equipment in any way
-
Report any mechanical issues, breakdowns, or accidents immediately by calling (956) 274-1624

Return equipment clean, undamaged, and with fuel at the same level it was provided
9. FUEL POLICY
-
Equipment is provided with a full tank of fuel unless otherwise noted at time of rental
-
Equipment must be returned with the same fuel level it was provided
-
If equipment is returned with less fuel than provided a fueling fee of $6.00 per gallon will be charged based on the amount needed to refill
-
Renter is responsible for using the correct fuel type for the equipment — diesel only for all heavy equipment and track loaders
-
Do not use regular gasoline in any rental equipment — damage caused by incorrect fuel is the renter's full financial responsibility
10. DAMAGE AND LOSS
Renter assumes full financial responsibility for all damage to or loss of rental equipment during the rental period including:

Accidental damage
-
Damage caused by improper operation or misuse
-
Damage caused by operating in conditions the equipment is not designed for
-
Theft or vandalism while in renter's possession
-
Damage caused by use of incorrect fuel or fluids
-
Damage caused by failure to report mechanical issues promptly
Renter will be charged the full cost of repair or replacement of any damaged or lost equipment at current market rates. Valley Stone Ranch Land Clearing & Development will obtain repair estimates and the renter will be responsible for payment within 10 business days of receiving the estimate.
Normal wear and tear that does not affect the function or safety of the equipment will not be charged to the renter.
11. INSURANCE
Valley Stone Ranch Land Clearing & Development does not carry general liability insurance on rented equipment while in the renter's possession. Renter is strongly encouraged to verify that their own homeowner's, renter's, or general liability insurance covers equipment rental and operation before taking possession of any equipment. Valley Stone Ranch Land Clearing & Development is not responsible for any third-party claims, property damage, or personal injury arising from the renter's operation of the equipment.
12. DELIVERY AND PICKUP

Delivery and pickup of equipment may be available depending on location — contact us for availability and pricing

Delivery fees are based on distance from La Feria, TX and will be confirmed at time of booking

Renter must ensure the delivery location is accessible for our transport vehicle and trailer
-
Renter is responsible for providing a safe, stable, and accessible area for equipment drop-off and pickup
-
Valley Stone Ranch Land Clearing & Development is not responsible for damage to driveways, roads, or property caused by delivery or pickup of equipment
13. BREAKDOWN AND MECHANICAL ISSUES

If equipment breaks down or malfunctions during the rental period renter must stop operation immediately and contact us at (956) 274-1624

Renter must not attempt to repair or adjust the equipment in any way
-
Valley Stone Ranch Land Clearing & Development will assess the issue and determine the appropriate course of action
-
If the breakdown is due to a mechanical defect not caused by renter misuse a pro-rated refund or replacement equipment may be provided at our discretion
-
If the breakdown is caused by renter misuse, overloading, or improper operation the renter remains responsible for the full rental cost and any repair costs
14. ACCIDENTS AND INJURIES
Renter assumes all risk of personal injury and property damage arising from the operation of rental equipment. Valley Stone Ranch Land Clearing & Development is not responsible for any injury to the renter, third parties, or damage to property resulting from the operation of rental equipment. In the event of an accident involving rental equipment renter must:

Ensure the safety of all persons involved

Call 911 if there are injuries or significant property damage

15. INDEMNIFICATION
Renter agrees to defend, indemnify, and hold harmless Valley Stone Ranch Land Clearing & Development, its owners, employees, and agents from and against any and all claims, damages, losses, costs, and expenses including attorney's fees arising out of or related to:

Renter's operation or misuse of rental equipment

Any injury to persons or damage to property caused by the equipment while in renter's possession

Renter's violation of any applicable law or regulation
-
Renter's breach of these Rental Terms and Conditions
16. GOVERNING LAW AND DISPUTES
These Rental Terms and Conditions are governed by the laws of the State of Texas. Any disputes arising from equipment rentals shall be resolved as follows:

Parties will first attempt good-faith negotiation

If negotiation fails parties agree to non-binding mediation in Cameron County, Texas
-
Any litigation shall be filed in the state courts of Cameron County, Texas
-
The prevailing party shall be entitled to recover reasonable attorney's fees and costs pursuant to Texas Civil Practice and Remedies Code Section 38.001
17. CHANGES TO THESE TERMS
Valley Stone Ranch Land Clearing & Development reserves the right to update or modify these Rental Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. The terms in effect at the time of your rental booking will govern that rental.
