INTRO: Please read these Terms and Conditions carefully before using our services, booking a project, or renting equipment from Valley Stone Ranch Land Clearing & Development. By booking our services, submitting a deposit, or using our website you agree to be bound by these terms. If you do not agree with any part of these terms please do not proceed with booking.
1. ABOUT US
Valley Stone Ranch Land Clearing & Development is a locally owned and operated land clearing and development company based in La Feria, Texas. 2. SERVICES
Valley Stone Ranch Land Clearing & Development offers the following services:

Land Clearing — removal of brush, mesquite, huisache, cedar, stumps, and debris
-
Land Grading and Leveling — shaping and leveling land for construction, driveways, and drainage
-
Excavating — foundation digging, pond building, dirt removal, and site preparation
-
Trenching — utility line, irrigation, and drainage trenching
-
Augering — fence post holes and support beam drilling
-
Heavy Equipment and Attachment Rentals — daily rental of track loader, excavator, and attachments
All services are performed using professional-grade equipment operated by experienced personnel. Services are provided on a per-hour basis unless otherwise agreed upon in writing.
3. QUOTES AND ESTIMATES
All quotes and estimates provided by Valley Stone Ranch Land Clearing & Development are based on information available at the time of quoting and represent estimated costs only. Final invoices reflect actual hours worked at the agreed hourly rates.

Quotes are valid for 30 days from the date issued

Estimated hours may vary based on actual site conditions

If work is completed in fewer hours than estimated the client pays only for actual time on site
-
If work requires more hours than estimated due to site conditions, hidden obstacles, soil conditions, or factors beyond Contractor's control the client agrees to pay for all actual hours worked

Contractor will notify client before exceeding the estimate by 2 or more hours
-
All changes to quoted scope of work must be agreed upon in writing via a signed change order before additional work is performed
4. DEPOSITS AND PAYMENT

A non-refundable deposit of 50% of the estimated project cost is required before mobilization
-
Balance is due upon substantial completion of work before equipment leaves the job site
-
All payments are due in full on the day of completion unless otherwise agreed in writing
-
Accepted payment methods: cash, check, Zelle, and other methods as agreed
-
Returned checks are subject to a $35 returned check fee
-
Late payments accrue interest at 1.5% per month on the outstanding balance
-
Contractor reserves the right to suspend work immediately for non-payment without liability
-
Client is responsible for all costs of collection including reasonable attorney's fees pursuant to Texas Civil Practice and Remedies Code Section 38.001
5. CANCELLATIONS AND REFUNDS
Please refer to our full Refund and Cancellation Policy for complete details. In summary:

Cancellations made more than 72 hours before the scheduled start date — full refund minus $150 administrative fee
-
Cancellations made between 24 and 72 hours before start date — 50% of deposit refunded
-
Cancellations made less than 24 hours before start date — no refund
-
Same day cancellations and no shows — full deposit forfeited and mobilization fee applies
-
Contractor-initiated cancellations due to weather, equipment failure, or emergency — full deposit refunded or job rescheduled at no charge
6. CLIENT RESPONSIBILITIES
By booking our services the client agrees to the following:

Client warrants they are the legal property owner or authorized agent with authority to approve the work
-
Client must call 811 at least 48 hours before any digging, trenching, or augering work begins
-
Client is responsible for all damage to unmarked or improperly marked utilities
-
Client is responsible for obtaining all required permits and authorizations before work begins
-
Client must disclose all known underground structures, irrigation lines, septic systems, fuel tanks, and subsurface improvements before work commences
-
Client must keep all unauthorized persons, children, and pets away from the work area during operations
-
Client is responsible for verifying their own property insurance coverage before work begins
7. LIMITATION OF LIABILITY
To the maximum extent permitted by Texas law, Valley Stone Ranch Land Clearing & Development's total liability to the client for any claim arising from services provided shall not exceed the total amount actually paid by the client under the applicable agreement.
Valley Stone Ranch Land Clearing & Development shall not be liable for:

Consequential, incidental, special, punitive, or indirect damages

Damage to unmarked or undisclosed underground utilities, structures, or improvements
-
Subsidence or settling of soil after completion of grading or clearing where compaction was not performed
-
Regrowth of vegetation after clearing
-
Erosion caused by weather after completion of work
-
Delays caused by weather, hidden site conditions, equipment breakdown, or factors beyond Contractor's control
-
Any injury to persons who enter the work zone without Contractor's knowledge or consent
8. INSURANCE
Valley Stone Ranch Land Clearing & Development does not currently carry general liability insurance. Clients acknowledge this fact before booking and are strongly encouraged to verify their own property insurance coverage before work begins. Contractor's liability is limited as described in Section 7 above.
9. LIEN RIGHTS
Client acknowledges Contractor's right to file a mechanic's and materialman's lien against the property pursuant to Texas Property Code Chapter 53 if payment is not timely made. Contractor shall provide required pre-lien notices in accordance with applicable Texas law.
10. EQUIPMENT RENTALS
Equipment rentals are governed by the terms of the Rental Agreement provided at time of booking. In addition to those terms the following apply:

Renter assumes full responsibility for equipment during the rental period
-
Renter is liable for all damage beyond normal wear
-
Equipment must be returned clean, undamaged, and with fuel at the same level it was provided
-
Delivery and pickup availability depends on location — call for pricing
-
A valid government-issued ID and deposit are required at time of booking
11. GOVERNING LAW AND DISPUTES
These Terms and Conditions are governed by the laws of the State of Texas. Any disputes arising from or related to these terms or our services shall be resolved as follows:

Parties will first attempt good-faith negotiation

If negotiation fails parties agree to non-binding mediation in Cameron County, Texas
-
Any litigation shall be filed in the state courts of Cameron County, Texas
-
The prevailing party shall be entitled to recover reasonable attorney's fees and costs pursuant to Texas Civil Practice and Remedies Code Section 38.001
12. WEBSITE USE
By using our website at www.valleystoneranch.com you agree that:

You will not use the site for any unlawful purpose

You will not attempt to gain unauthorized access to any part of the site

All content on the site including text, images, and logos is the property of Valley Stone Ranch Land Clearing & Development and may not be reproduced without written permission

We collect basic contact information when you submit a quote request or booking form including your name, phone number, email, and property address. This information is used solely to respond to your inquiry and schedule your project. We do not sell or share your information with third parties. 14. CHANGES TO THESE TERMS
Valley Stone Ranch Land Clearing & Development reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
